Contract and Liability Release* WAIVER OF LIABILITY: The client expressly releases Carlye Morgan Photography LLC. (hereby defined as the photographer, contract photographer(s), employee(s), and/or other Carlye Morgan Photography agents ) from all claims, injuries, damages, and liabilities that may result from accidents or incidents that may occur during the photo session. Carlye Morgan is also not responsible for any damages incurred or caused by you or your party before, during, or after your session (i.e. parking tickets, fines, or damage to location or venue, etc.) COVID-19: An inherent risk of exposure to COVID-19 exists in any public place where people are present. By visiting and/or participating in the Activities at the Company, you, any minor child(ren) and ward(s) voluntarily assume all risks related to exposure to COVID-19. FAILURE TO PERFORM: If Carlye Morgan Photography cannot perform this agreement in whole or in part due to fire , flood, or other disaster, acts of nature or terror, or other cause beyond the control of Carlye Morgan Photography, responsibility and liability is limited to the refund of the full package amount agreed upon in this agreement. Carlye Morgan takes the utmost care with respect to exposure, transportation, and processing of photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within and beyond the control of Carlye Morgan Photography, responsibility and liability is limited to the refund of the full package amount agreed upon in this agreement. The limit of liability for a partial loss of photographs shall be a prorated amount based upon the percentage of photographs lost. TECHNOLOGY FAILURE: It is extremely unlikely for anything to go wrong, but it is possible to experience technical issues with equipment when shooting/filming the Event. This could include SD cards breaking, cameras overheating, malfunctions, or equipment theft. Client agrees Company is not responsible for technology failures of any kind that may happen during or after the Event. COPYRIGHT: All images taken at your session will be copyrighted by Carlye Morgan Photography and are protected by Federal Copyright Law. Carlye Morgan Photography posses the right to use images, prints, or other works produced from your shoot for display, publication, advertising, etc., without restriction. To maintain the brand of Carlye Morgan Photography, please do not edit or alter any images whether it be for print or display on the internet (this includes Facebook, blogs and filters on Instagram). GARMENTS: Carlye Morgan Photography cannot be held responsible for damage to Garments due to environmental events. This includes wedding dresses, shoes, veils, etc. You are responsible to arrange safe handling and/or personal assistance for the handling of your garments. CREATIVE LICENSE: I understand that photography is subjective in nature and the final product is a product of the creativity of Carlye Morgan Photography. I also understand that the final images edited and delivered are the images that Carlye Morgan Photography feel best represent the Carlye Morgan Photography brand, product, and my session. I also understand that I will not receive any unedited (RAW) files, I will not receive every image captured during my session, and any requests for reediting will be priced at $25 per image. MODEL RELEASE: By typing my name below, I hereby consent that the photographs taken and delivered of me and the other members of my party (including minor children) may be used by Carlye Morgan Photography for the purpose of display, portfolio, advertising, blog, website or publication to promotion without compensation to myself or the parties involved. By entering your name and submitting this form, you are agreeing to the terms of this contract for yourself or any minors participating in this photoshoot.
